Perfecting Church, its subsidiaries and affiliated organizations (together, the “Church”), will conduct the Marvin Winans “Survivor” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:
1. NO PURCHASE NECESSARY; void where prohibited. Auditions will be conducted on Saturday, February 2, 2008 and Saturday, February 16, 2008, at Perfecting Church located at 7616 E. Nevada, Detroit. Final judging will be conducted on Monday, March 3, 2008, at Winans Academy of Performing Arts, located at 9740 McKinney, Detroit.
2. Participants must register at www.perfectingchurch.org/ mwsurvivor or at Perfecting Church beginning on January 14, 2008. A one-time $50.00 registration fee is required to audition for the Contest. The Church will accept money orders, credit card, or cash for the registration fee (checks will not be accepted). Participants will be notified of their audition date within 48 hours of payment of the registration fee. Registration fees are non-refundable and non-transferable.
3. The Contest is not open to professional singers or performers; no participant contracted under a recording and/or production deal may participate in the audition or contest. Participants less than 18 years of age must be accompanied by a parent or legal guardian.
4. No group may exceed more than 4 people.
5. Participants may only perform songs written or recorded by Marvin Winans or The Winans singing group.
6. Participants may only perform to CD track, piano/keyboard or organ for auditions (no band performance allowed for auditions).
7. Judging will take place on February 2, 2008 and February 16, 2008. A three-judge panel will judge participants on performance and stage presence on a scale of 1-10. The five highest scoring participants will become finalists. Participants selected as finalists will be notified by February 20, 2008. Final judging will take place on March 3, 2008. Finalists will perform before a 3 or 5 judge panel. The grand prizewinner will be the finalist whose performance received the highest score.
8. Publicity; Use of Personal Information. By participating, all
participants and winner(s) grant the Church exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this Contest and waive any claims to royalty, right, or remuneration for such use.
9. The Church will award one (1) Grand Prize to the winner of the Contest; no other prizes will be awarded. Prizes are not transferable, or exchangeable for any other prize. If a winner cannot be contacted or is disqualified, the Church reserves the right to determine an alternate winner or not to award that winner’s prize,
at its sole discretion.
10. Eligibility and Limitations. Participants and winner(s) must be U.S. residents. Employees of the Church, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, or other family extension, and any other persons residing at the same household whether or not related. |

11. Release. By participating in the Contest, each participant and winner waives any and all claims of liability against the Church, its employees and agents, directors, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Church.
12. Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Church, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which is not specifically provided for in the official rules. Each winner must provide the Church with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from the Church will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
13. Conduct and Decisions. All participants agree to be bound by the decisions of Church or its agents. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Church will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Church’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Church, the Church reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Church deems appropriate. All decisions will be made by the Church and are final. The Church may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CHURCH RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
14. Miscellaneous. Each winner must submit proof of eligibility and sign the Church’s release form to claim the prize. The Church may substitute prizes or amend Contest rules at Church’s sole discretion.
15. Compliance with Law. The applicable laws of the Unites States of America, which take precedence over any rule to the contrary herein, govern the conduct of the Contest. The Church shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, or as otherwise required by local and state law.
